For use throughout the Navy-Marine Corps trial judiciary and in all Navy-Marine Corps judicial circuits, this trial guide presents basic procedures for a court-martial military judge acting alone (in contrast to a multiple-member deliberative body).
Abstract
It contains word-for-word statements to be made by the military judge and trial counsel (prosecutor) to ensure that every aspect of the trial is conducted in accordance with the Rules of Court-Martial. If case precedent mandates trial requirements in addition to the Rules of Court-Martial, these are included in the script. Explanatory comments accompany each page of the script. The procedures encompass the initial session, arraignment, providency inquiry (to ascertain that the accused understands the implications of a guilty plea), pretrial agreement inquiry, acceptance of a guilty plea, contested case on the merits, announcement of findings, sentencing hearing, announcement of sentence, and statement of appellate rights.
