DATA ON RAPE TRIALS OVER A 10 YEAR PERIOD IN QUEENSLAND, AUSTRALIA, IS USED TO DETERMINE HOW VARIOUS OFFENDER, VICTIM, AND CRIME SITUATION CHARACTERISTICS INFLUENCED, OR FAILED TO INFLUENCE, THE JUDGES AND JURIES INVOLVED.
Abstract
THE ONLY FACTORS FOUND TO HAVE ANY APPARENT EFFECT ON BOTH JUDGES AND JURIES WERE THE MORAL BEHAVIOR OF THE FEMALE CONCERNED IN THE CASE AND, IF SINGLE, HER CHASTITY. APART FROM THE INFLUENCE OF THESE FACTORS, THE AUTHOR REPORTS HAVING FOUND NO EVIDENCE OF SENTENCING INCONSISTENCY. (AUTHOR ABSTRACT MODIFIED)
