THE NATURE OF THE JUDICIAL PROTECTION OF INDIVIDUALS AND UNDERTAKINGS IS DESCRIBED WITHIN THE SPHERE OF EUROPEAN COMMUNITY LAW AND THE LAW OF THE MEMBER STATES.
Abstract
THE BOOK IS DIVIDED INTO TWO SECTIONS: LEGAL ORDER AND THE COURTS. A DESCRIPTION OF THE EUROPEAN COMMUNITY LEGAL ORDER, I.E., THE RULES WHICH MAKE UP COMMUNITY LAW, INTRODUCES THE VOLUME. THE BORDERLINES AND EXTREMITIES OF THIS LEGAL ORDER ARE THEN MAPPED OUT, INCLUDING THE QUESTION OF WHICH ACTS STILL BELONG TO IT AND THE REVIEW OF THE VALIDITY OF ACTS TAKEN BY COMMUNITY INSTITUTIONS. ALTHOUGH THE CASE LAW OF THE COURT OF JUSTICE PLAYS A PROMINENT ROLE IN THESE FIRST TWO SECTIONS, THEY DO NOT BASICALLY DEAL WITH THE TOPIC OF THE COURT. SUBSEQUENT CHAPTERS DEAL WITH THE EUROPEAN AND NATIONAL COURTS THEMSELVES, BEGINNING WITH A DISCUSSION OF THE TASKS OF THE COURT OF JUSTICE OTHER THAN THAT OF JUDICIAL REVIEW (THIS SPECIFIC FUNCTION OF THE COURT IS COVERED IN A SEPARATE CHAPTER). THE ROLE PLAYED BY OTHER COURTS AND THE STRUCTURE AND OPERATION OF THE COURT OF JUSTICE ARE DESCRIBED IN OTHER CHAPTERS.
