This volume of The Judicial Review presents six papers covering issues related to the laws in Australia.
Abstract
The first paper, International Commercial Dispute Resolution and the Place of Judicial Power, considers the role of Commonwealth and State judicial powers in the field of international commercial disputation. The second paper, Some Reflections on the Sources of our Law, provides an overview of the various sources of law in Australia. The third article, The New Regime of Practice in the Equity Division of the Supreme Court of NSW, discusses the recommendations presented in the 2011 report by the Australian Law Reform Commission. The fourth paper, Evidence-Based Law: Its Place in the Criminal Justice System, describes the genesis of modern empiricism and its dominating role in legal scholarship today. The fifth paper, Basic Categories of Argumentation in Legal Reasoning, contains an introduction to the principles of logic and methods of argumentation most common to law and legal discourse. The sixth paper, The Australian National Jury Sex Offence Sentencing Study, details the results of a study that explored the views of jurors regarding the appropriateness of sentences imposed on sex offenders and sentencing in general.
