A DISCUSSION OF THE RELATIONSHIP BETWEEN INDIANS AND THE FEDERAL INVESTIGATIVE AND PROSECUTIVE AGENCIES RESPONSIBLE FOR ENFORCING THE LAW ON INDIAN RESERVATIONS.
Abstract
THIS STUDY FOCUSES ON THREE FEDERAL AGENCIES - THE BUREAU OF INDIAN AFFAIRS BRANCH OF LAW AND ORDER, THE FEDERAL BUREAU OF INVESTIGATION, AND THE OFFICE OF UNITED STATES ATTORNEY. QUESTIONNAIRES AND INTERVIEWS WERE DESIGNED TO OBTAIN BASIC INFORMATION CONCERNING FEDERAL PROSECUTION OF CRIMES COMMITTED ON INDIAN RESERVATIONS. AFTER A BRIEF DISCUSSION OF HOW THE FEDERAL GOVERNMENT BECAME INVOLVED IN PROSECUTING CRIMES COMMITTED ON INDIAN RESERVATIONS, THE DOCUMENT DESCRIBES HOW THE PRESENT SYSTEM OPERATES THROUGH THE USE OF AN ANATOMY OF A FEDERAL OFFENSE COMMITTED ON AN INDIAN RESERVATION. THE FINDINGS OF THE STUDY ARE DIVIDED TO COVER, SEPARATELY, THE THREE AGENCIES BEING STUDIED. IN CONCLUSION, CONSTRUCTIVE RECOMMENDATIONS FOR CORRECTION ARE OFFERED. THE APPENDIX INCLUDES POSSIBLE REMEDIES, SAMPLE QUESTIONNAIRES, A SAMPLE FEDERAL OFFENSE VIOLATION REPORT AND STATISTICAL FINDINGS FROM THE BUREAU OF INDIAN AFFAIRS BRANCH OF LAW AND ORDER.
