Statistical data from the Environment Component of the Public Service Alliance of Canada underlie this report of outcomes of 228 employee grievances filed with the Environment Component from January 1977 to June 1979.
Abstract
Each grievance was examined according to type, duration, identity of the final management personnel to hear the case, outcome, and adjudicability. The 228 grievance tabulations were categorized by whether the grievance was adjudicable or nonadjudicable under Section 91 of the Public Service Staff Relation Act. The 119 nonadjudicable grievances represent 16 types of complaints. These were further organized into the classes of termination of employment, directives, staffing, special leave, miscellaneous, and appraisal. The remaining 109 adjudicable grievances resulted from 19 types of complaints reorganized into the classes of pay, discipline, leave, special leave, and miscellaneous. Ten percent (22 of 228) of all grievances and 20 percent of all adjudicable grievances handled by the Environment Component were adjudicated. Of these, 4 in 5 were decided in favor of the grievor. For nonadjudicable grievances, 100 percent of the cases were settled in favor of the grievor, but there were only two cases. Every class of adjudicable grievances indicates more pro-grievor than anti-grievor action; whereas, pro-grievor action occurred for only 2 out of 6 nonadjudicable classes (miscellaneous and appraisal). The restriction placed on the types of grievances eligible for adjudication is believed to hinder justice for aggrieved employees.
