ARTICLE COMPARES MEXICAN CRIMINAL JUSTICE SYSTEM AND THE DEFENDANT'S GUARANTEES TO THAT OF THE UNITED STATES.
Abstract
THE MEXICAN CONSTITUTION WAS ADOPTED IN 1917 AND IS PATTERNED AFTER THAT OF THE UNITED STATES. IT HAS MORE SIMILARITIES THAN IT HAS DIFFERENCES WITH THE BILL OF RIGHTS. THE RIGHT TO PUBLIC TRIAL IS GUARANTEED, AS ARE SAFEGUARDS ON PRIVACY, AND AGAINST SEARCH AND SEIZURE. THE RIGHTS TO BAIL, TO SPEEDY TRIAL, TO CONFRONT WITNESSES, AND TO CROSS EXAMINE COMPLAINING WITNESSES ARE GUARANTEED. THE FEDERAL CRIMINAL CODE IS MORE DETAILED THAN THAT OF THE UNITED STATES, AND DEFINES THE POWERS AND DUTIES OF THE PROSECUTION, AND THE RIGHTS AND DUTIES OF THE DEFENDANT AND HIS COUNSEL....BS
