THE CURRENT ORGANIZATION OF THE CRIMINAL JUSTICE SYSTEM IN QUEBEC IS DESCRIBED, LAWS AND ADMINISTRATIVE MEASURES TO REFORM THIS SYSTEM WHICH HAVE RECENTLY BEEN ENACTED ARE REVIEWED, AND NEEDED CHANGES ARE SUMMARIZED.
Abstract
THIS COMPREHENSIVE OVERVIEW BEGINS WITH A DETAILED DESCRIPTION OF THE POLICE, COURTS, AND ADMINISTRATIVE TRIBUNALS IN QUEBEC AND EXPLAINS THE REFORMS WHICH HAVE TAKEN PLACE DURING THE PAST 15 YEARS. AN ORGANIZATIONAL CHART ILLUSTRATES A DISCUSSION OF THE WORK OF THE FOLLOWING SECTIONS: CRIMINAL AFFAIRS BRANCH; CIVIL AND PENAL AFFAIRS BRANCH; QUEBEC POLICE FORCE, POLICE INSTITUTE, AND POLICE COMMISSION; PUBLIC SAFETY BRANCH; SECURITY DIVISION; INSTITUTE OF FORENSIC MEDICINE AND SCIENCE; CIVIL PROTECTION DIVISION; PROBATION AND HOUSES OF DETENTION BRANCH; AND THE COMMISSIONS AND BOARDS REGULATING VARIOUS COMMERCIAL ACTIVITIES. THE JUDICIAL SUPPORT AND RECORDS FUNCTIONS ARE ALSO EXAMINED, AND THE PROPOSED REORGANIZATION OF QUEBEC'S COURTS IS DESCRIBED AND ILLUSTRATED WITH A FLOW CHART. PROPOSALS FOR REORGANIZATION OF THE VARIOUS ADMINISTRATIVE TRIBUNALS ARE THEN REVIEWED. ONE CHAPTER EXAMINES PROPOSALS WHICH HAVE BEEN ADVANCED FOR THE ESTABLISHMENT OF A SEPARATE FAMILY AND YOUTH PROTECTION COURT; ANOTHER GIVES A PROFILE OF QUEBEC'S JUDGES AND ADVANCES SUGGESTIONS FOR CONTINUED INSERVICE TRAINING AND A JUDICIAL COMMISSION TO OVERSEE COMPLAINTS AND REMOVALS FOR CAUSE. IMPROVED CASE MANAGEMENT, LAW REFORM, IMPROVED ACCESS TO JUSTICE FOR CITIZENS, AND IMPROVED TREATMENT OF VICTIMS AND WITNESSES ARE ALSO COVERED. THE REPORT IS COPIOUSLY ILLUSTRATED WITH CHARTS, GRAPHS, STATISTICS, CITATIONS FROM LAW, AND SUPPORTING DATA. A 37-PAGE SECTION CONTAINS RECOMMENDATIONS GROWING OUT OF THIS STUDY.
