STATUTES OF EACH OF THE 50 STATES AND THE DISTRICT OF COLUMBIA ARE EXAMINED FOR TERMINOLOGY AND DEFINITIONS COVERING THOSE CATEGORIES OF JUVENILE JURISDICTION COMMONLY CALLED 'DELINQUENCY' AND 'STATUS OFFENSES.'
Abstract
THIS MONOGRAPH IS THE FIRST IN A SERIES OF PUBLICATIONS ANALYZING JUVENILE STATUTES ON A VARIETY OF TOPICS. TABLES AND NARRATIVE SET FORTH CATEGORIES OF CONDUCT ATTACHED TO THESE JURISDICTIONAL CATEGORIES BY STATE STATUTES, THE MODEL FAMILY COURT ACT, THE UNIFORM JUVENILE COURT ACT, THE STANDARD JUVENILE COURT ACT, AND THE IJA-ABA JUVENILE JUSTICE STANDARDS PROJECT. THE RESULTS OF THE STUDY GRAPHICALLY ILLUSTRATE THE LEGISLATIVE DEPARTURE FROM THE CRIMINAL-NONCRIMINAL DISTINCTION CONNOTED BY THE TERMS 'DELINQUENCY' AND 'STATUS OFFENSE.' FUTURE MONOGRAPHS WILL ADDRESS STATUTORY PROVISIONS FOR TRANSFER OF JURISDICTION BETWEEN JUVENILE COURT AND CRIMINAL COURT, CONFIDENTIALITY OF RECORDS AND PROCEEDINGS, JUDICIAL VERSUS EXECUTIVE CONTROL OVER COMMITMENT AND RELEASE, DETENTION AND PROBABLE CAUSE HEARINGS, DIVERSION FROM FORMAL COURT PROCEEDINGS, AND RELATED MATTERS.
