EXAMINES STATUTES RELATING TO JUVENILE COURTS THROUGHOUT THE 50 STATES AND THE DISTRICT OF COLUMBIA TO PROVIDE FACTUAL INFORMATION ON THE STATE OF THE LAW.
Abstract
THE CONTENTS OF THIS PAPER ARE DERIVED FROM AN EXAMINATION OF THE STATUTES RELATING TO JUVENILE COURTS THROUGHOUT THE FIFTY STATES AND THE DISTRICT OF COLUMBIA. THE PRIMARY INTENTION IS TO PROVIDE FACTUAL INFORMATION ON THE STATE OF THE LAW. THAT INFORMATION DOES NOT NECESSARILY DESCRIBE THE ACTUAL PRACTICE AND PROCEDURES THROUGHOUT THE JUVENILE JUSTICE SYSTEM. THE RESEARCH WAS DONE DURING 1974; BUT DUE TO DELAYS IN THE DISTRIBUTION OF STATUTES TO LAW LIBRARIES, THERE MAY BE SOME 1974 AMENDMENTS NOT INCLUDED. PART I OF THIS DOCUMENT PRESENTS INFORMATION ON COURTS WITH JUVENILE JURISDICTION. COMMENTS ARE MADE ON TRIAL LEVEL AND ORGANIZATION OF COURTS WITH JUVENILE JURISDICTION AND TRIAL LEVEL AND ORGANIZATION UNDER THE MODEL ACTS. A TABLE PROVIDES INFORMATION ON THE ORGANIZATION OF COURTS BY STATE FOR ALL 50 STATES AND THE DISTRICT OF COLUMBIA. THE ORGANIZATION OF COURTS UNDER THE MODEL ACTS INCLUDING THE U. S. DEPARTMENT OF HEALTH, EDUCATION AND WELFARE LEGISLATIVE DRAFTING GUIDE FOR FAMILY AND JUVENILE COURT ACTS, THE UNIFORM JUVENILE COURT ACT APPROVED BY THE NATIONAL CONFERENCE OF COMMISSIONERS ON UNIFORM STATE LAWS AND THE A.B.A., AND THE STANDARD JUVENILE COURT ACT BY THE NATIONAL COUNCIL ON CRIME AND DELINQUENCY ARE ALSO EXAMINED. THE AUTHORS THEN FOCUS ON THE RECORDING OF HEARINGS, COVERING TOPICS SUCH AS THE REQUIREMENT OF A VERBATIM RECORDING AND VERBATIM RECORDINGS UNDER THE MODEL ACTS. IN EXAMINING REFEREES AND MASTERS, COMMENTS ARE MADE ON STATUTORY PROVISIONS FOR REFEREES OR MASTERS, AND FOR REFEREES UNDER THE MODEL ACTS. PART II OF THIS DOCUMENT DEALS WITH STATUS OFFENSES. STATUTORY CLASSIFICATION OF STATUS OFFENSES BY STATE AND CLASSIFICATION OF STATUS OFFENSES UNDER THE MODEL ACTS ARE AMONG THE TOPICS DISCUSSED IN THIS SECTION. A GLOSSARY PROVIDES DEFINITIONS OF TERMS USED THROUGHOUT THE DOCUMENT. (SNI ABSTRACT)
