ANALYSIS AND DEVELOPMENT OF CONSTITUTIONAL CHALLENGES TO JUVENILE COURT JURISDICTION OVER BOTH CRIMINAL AND NONCRIMINAL MISCONDUCT OF CHILDREN IN OHIO.
Abstract
OHIO LAW GRANTING JUVENILE COURTS JURISDICTION OVER A YOUTH BY FINDING HIM EITHER DELINQUENT OR UNRULY IS EXAMINED. ARGUMENTS STRESSING THE UNCONSTITUTIONALITY OF THE STATUTUE BASED ON CLAIMS OF STATUTORY VAGUENESS AND OVERBREADTH, DENIAL OF PROCEDURAL DUE PROCESS AND DENIAL OF EQUAL PROTECTION ARE DEVELOPED. ABOLITION OF JUVENILE COURT NONCRIMINAL JURISDICTION IN FAVOR OF ALTERNATIVE COMMUNITY SERVICES FOR TROUBLED YOUTH IS RECOMMENDED.
