AFTER STUDY, CONGRESS AMENDED THE JUVENILE JUSTICE ACT OF 1974 TO REAUTHORIZE THE PROGRAMS ESTABLISHED UNDER THE ACT FOR ANOTHER 3 YEARS AND TO MAKE SEVERAL ADMINISTRATIVE CHANGES.
Abstract
THE JUVENILE JUSTICE AND DELINQUENCY PREVENTION ACT OF 1974 WAS A FEDERAL INITIATIVE TO IMPROVE THE JUVENILE JUSTICE SYSTEM AND TO PROVIDE FOR PROGRAMS TO PREVENT JUVENILE DELINQUENCY. THE JUVENILE JUSTICE AMENDMENTS OF 1977 EXTENDED EXISTING PROGRAMS FOR 3 YEARS, PROVIDED FOR THE OFFICE OF 'ASSOCIATE ADMINISTRATOR OF THE OFFICE OF JUVENILE JUSTICE AND DELINQUENCY PREVENTION' TO AID THE ADMINISTRATOR, STRENGTHENED EVALUATION REQUIREMENTS, PROVIDED FOR THE ESTABLISHMENT OF AN ADVISORY COMMITTEE OF NOT LESS THAN FIVE MEMBERS, AND CLARIFIED FUNDING CRITERIA FOR PREVENTION AND TREATMENT PROGRAMS. THIS IS A COMPLETE COPY OF THE 1974 ACT WITH THE AMENDMENTS OF 1977. A MAJOR CHANGE IS THAT GRANTS AND CONTRACTS HAVE NOW BEEN AUTHORIZED FOR PROJECTS DEVELOPED IN COORDINATION WITH THE COMMISSIONER OF EDUCATION TO ENCOURAGE NEW APPROACHES AND TECHNIQUES TO PREVENT SCHOOL VIOLENCE AND VANDALISM, FOR PROGRAMS DEVELOPED IN CONJUNCTION WITH THE SECRETARY OF LABOR TO INCREASE YOUTH EMPLOYMENT, AND FOR PROGRAMS TO IMPROVE DUE PROCESS IN THE JUVENILE JUSTICE SYSTEM. PROGRAMS STRESSING 'ADVOCACY ACTIVITIES AIMED AT IMPROVING SERVICES TO YOUTH IMPACTED BY THE JUVENILE JUSTICE SYSTEM' ARE ALSO AUTHORIZED. IT IS SPECIFIED THAT AT LEAST 25 PERCENT OF THE FUNDS MADE AVAILABLE EACH YEAR SHALL BE FOR PREVENTION AND TREATMENT PROGRAMS. AN APPENDIX LISTS OTHER ACTS WHICH ARE MODIFIED BY THE AMENDMENTS AND GIVES THESE STATUTORY CHANGES. SECTIONS 203 (A) (1) AND 519 OF THE OMNIBUS CRIME CONTROL AND SAFE STREETS ACT OF 1968, SECTION 4351 (B) OF TITLE 18 U.S. CODE, AND SECTION 5316 OF TITLE 5 U.S. CODE ALL UNDERGO MINOR REVISIONS IN WORDING WHILE SECTION 5038 (A) OF TITLE 18, U.S. CODE RECEIVES A NEW SECTION SPECIFYING THAT ANY INQUIRY FROM ANY VICTIM OF JUVENILE DELINQUENCY (OR IF THE VICTIM IS DECEASED, FROM THE FAMILY) RELATED TO THE DISPOSITION OF THE CASE SHOULD BE HONORED. THIS ADDITION IS MADE IN THE SECTION LISTING EXCEPTIONS TO THE SEALING OF JUVENILE RECORDS. (GLR)
