ORIGINALLY PRESENTED AS A DENIS CARROL MEMORIAL LECTURE, THIS PAPER EXAMINES THE JUVENILE COURT SYSTEM AND ITS ALTERNATIVES IN ENGLAND AND SCOTLAND, AND SETS OUT CRITERIA FOR EXAMINING THE JUVENILE JUSTICE SYSTEM.
Abstract
THE AUTHOR PROVIDES A COMPARATIVE STUDY OF THE ENGLISH AND SCOTTISH SYSTEMS OF JUVENILE JUSTICE. HE ALSO SETS FORTH FIVE QUESTIONS TO BE USED IN ASSESSING JUVENILE JUSTICE SYSTEMS: 1) DOES THE SYSTEM ENCOURAGE GOOD COMMUNICATION BETWEEN JUVENILE JUSTICE DECISION-MAKERS AND AVAILABLE SERVICES FOR JUVENILES? 2) CAN THE SYSTEM DISTINGUISH BETWEEN JUVENILES WHOSE BEHAVIOR IS CAUSED BY SOCIAL DEPRIVATION AND THOSE WHOSE BEHAVIOR IS NOT? 3) IS THE DECISION-MAKING PROCESS UNDERSTANDABLE? 4) ARE THERE ADEQUATE SAFEGUARDS FOR THE RIGHTS OF CHILDREN AND PARENTS? AND 5) IS THERE AN ADEQUATE RANGE OF TREATMENT MEASURES AVAILABLE?
