New York State juvenile arrest and court data are provided and discussed for the 3 years following the enactment of the law specifying that 13 to 15 year-olds are subject to prosecution in adult criminal courts for certain violent felonies.
Abstract
During the 40 months since the 'juvenile offender' legislation has been in effect, 4,572 juveniles arrested in New York City have been subject to prosecution in adult court, representing 86 percent of the juvenile offender arrests statewide. Of this number, 4,540 have reached criminal court. Forty-three percent of the juveniles arraigned, however, have been removed to the family court either by the criminal court or the grand jury. A total of 679 of the 830 convicted juvenile offenders have been sentenced to date. A total of 280 received probation, and 387 (45 percent) have been sentenced to prison as juvenile offenders. Seventeen juveniles (3 percent) convicted of second-degree murder have received sentences with maximum terms of life imprisonment. The majority of detained juvenile offenders spend relatively short periods in detention. The typical victim of the juvenile offender is a peer aged 13-19. Tabular data are provided on length of detention, arrests by crime and county, court action by county, dispositions of indicted cases, sentences by county, ages of victims, as well as statewide data.
