THIS REPORT DISCUSSES THE VARIOUS STATE LAWS ON THE ISSUES OF COURT JURISDICTION OVER THE STATUS OFFENDER, POST-ADJUDICATORY DISPOSITIONS FOR STATUS OFFENDERS, AND PERMISSIBILITY OF INCARCERATION OF ADULTS WITH JUVENILES.
Abstract
IN ADDITION, INFORMATION IS PROVIDED ON WHAT THE ACTUAL PRACTICE IS ON THESE ISSUES IN A NUMBER OF STATES SELECTED AS ILLUSTRATIVE OF THE VARIOUS APPROACHES AND POSTURES BEING TAKEN TOWARDS THE STATUS OFFENDER AND THE DETAINED JUVENILE. THE STATES HIGHLIGHTED ARE ALABAMA, FLORIDA, IOWA, MAINE, MARYLAND, MICHIGAN, NEW MEXICO, NEW YORK, OREGON, VERMONT, AND WASHINGTON. ALSO INCLUDED IS A DISCUSSION ON CONSTITUTIONAL ISSUES RELATING TO THE STATE'S JURISDICTION OVER JUVENILES WHO COMMIT STATUS OFFENSES, AND THE POSITIONS THAT NATIONAL CRIMINAL GROUPS ARE TAKING REGARDING THE RESTRICTION OF COURTS' INVOLVEMENT WITH THIS POPULATION.
