This study examines juvenile transfers to criminal court as well as youth retained in the juvenile court system in Florida.
Abstract
In Florida, as in no other state, transfer has come to rival juvenile justice placement as a disposition for young offenders. Since the mid-1970s, the Florida legislature has incrementally expanded both the methods by which cases may be transferred and the scope of eligibility criteria. These provisions include lowering the age of juveniles who may be transferred and increasing the number of offenses that could be considered for transfer. The report is presented in sections concerning: (1) The Processes and Players Involved in Transfers of Juveniles for Prosecution as Adults in Florida: A Legislative and Legal History (including Sentencing and Dispositional Alternatives and Procedures for Youth Prosecuted as Adults); (2) The Impact of the 1994 Juvenile Justice Reform Act (including Processing Stages for Juveniles Transferred to Adult Court 1993 and 1995); (3) Policies and Perceptions of Juvenile Justice Practice (including Survey of Prosecutors and Judges); (4) Interviews With Juvenile Offenders; and (5) In-Depth Circuit Court Data.
