THE COMPLIANCE OF THE STATE OF KANSAS TO SECTION 223 OF THE JUVENILE JUSTICE AMENDMENTS OF 1977 IS MONITORED FOR 1979.
Abstract
THE INVESTIGATION MONITORED THE PROGRESS KANSAS MADE TOWARD THE REMOVAL OF STATUS OFFENDERS FROM JUVENILE CORRECTIONAL/DETENTION FACILITIES THE SIGHT AND SOUND SEPARATION OF JUVENILES FROM ADULTS IN SECURE FACILITIES. WITH REGARD TO THE REMOVAL OF STATUS OFFENDERS, A MAIL/TELEPHONE SURVEY AND ON-SITE INSPECTIONS BY MEMBERS OF THE GOVERNOR'S COMMITTEE ON CRIMINAL ADMINISTRATION INDICATED AN OVERALL REDUCTION OF 31 PERCENT IN THE NUMBER OF ACCUSED STATUS OFFENDERS/NONOFFENDERS HELD IN JUVENILE DETENTION AND CORRECTIONAL FACILITIES AS COMPARED TO 1978, AND AN OVERALL REDUCTION OF 46 PERCENT IN THE TOTAL NUMBER OF ADJUDICATED STATUS OFFENDERS AND NONOFFENDERS HELD IN JUVENILE DETENTION AND CORRECTIONAL FACILITIES FROM MARCH 1978 TO MARCH 1979. IN REFERENCE TO THE SEPARATION OF JUVENILES, RESULTS OF THE ANNUAL INSPECTIONS/EVALUATIONS BY THE DEPARTMENT OF CORRECTIONS AND A MAIL SURVEY INDICATED A REDUCTION OF 80 PERCENT IN THE TOTAL NUMBER OF JUVENILE OFFENDERS AND NONOFFENDERS ADMITTED TO COUNTY JAILS OR LOCKUPS WHICH DID NOT PROVIDE ADEQUATE SEPARATION OF JUVENILES AND ADULTS. THE STATE HAS NOT YET ACHIEVED THE 75 PERCENT REDUCTION REQUIRED TO COMPLY WITH THE REMOVAL OF JUVENILES CLAUSE BY DECEMBER 1980, WHILE IT IS ALREADY IN COMPLIANCE WITH THE SEPARATION OF JUVENILES CLAUSE. FEDERAL DEFINITIONS OF TERMS, CORRECTIONAL FACILITIES INCLUDED IN THE REPORT, COVER LETTERS, AND NUMERICAL RESULTS OF THE SURVEYED FACILITIES ARE APPENDED. TABULAR DATA ARE INCLUDED.
