DATED JUNE 1976, THIS REPORT PRESENTS PROPOSED RULES OF ORGANIZATION AND PROCEDURE FOR THE KENTUCKY COURT OF APPEALS, WHICH SERVES AS THE COURT OF FIRST REVIEW TO WHICH APPEALS AS A MATTER OF RIGHT MAY BE TAKEN.
Abstract
IN 1975, KENTUCKY ESTABLISHED A NEW INTERMEDIATE APPELLATE COURT, THE COURT OF APPEALS. THIS COURT WAS TO HAVE FOURTEEN JUDGES. SHORTLY AFTER PASSAGE OF THE JUDICIAL ARTICLE, KENTUCKY'S OFFICE OF JUDICIAL PLANNING BEGAN THE DEVELOPMENT OF TWO SETS OF PROPOSED RULES FOR THE COURT OF APPEALS: ONE FOR PROCEDURE AND ONE FOR ORGANIZATION. THIS TECHNICAL ASSISTANCE EFFORT WAS UNDERTAKEN TO SECURE REVIEW OF THESE RULES. THE REPORT CONTAINS THE TEXT OF THE PROPOSED RULES, A COMMENTARY ON THE RULES AS A WHOLE, AND SPECIFIC COMMENTS ON EACH PROPOSED RULE....DMC
