AN AUSTRIAN PROSECUTOR AND FORMER JUDGE ARGUES AGAINST PUNISHMENT AS A SOCIAL INSTITUTION FOR DEALING WITH CRIME AND RELATES THE DISCUSSION TO THE ISSUE OF CRIMINAL JUSTICE REFORM IN AUSTRIA AND WEST GERMANY.
Abstract
THE AUTHOR ARGUES THAT PUNISHMENT OF CRIMINALS SERVES PRIMARILY AS A WAY FOR SOCIETY TO DIRECT AND WORK OFF ITS AGGRESSIVE ENERGIES. HE FURTHER CONTENDS THAT IMPRISONMENT ONLY HAS THE EFFECT OF SPREADING CRIMINAL BEHAVIOR AND THAT CAPITAL PUNISHMENT SHOULD BE ABOLISHED. HE DISCUSSES ALTERNATIVES TO PUNISHMENT IN CRIME DETERRENCE AND PREVENTION. --IN GERMAN
