This manual presents practical procedures intended to help both the law clerk and the judge for whom the clerk is working to work effectively together, based on the experiences of the authors and a review of manuals in use in other courts.
Abstract
An introduction explains the function of the law clerk, differences in the responsibilities of a trial law clerk and of an appellate law clerk, preparation for clerking, and continuing education. Additional sections explain the conduct expected of the law clerk, the avoidance of conflicts of interest, loyalty requirements, courtroom demeanor, neutrality and impartiality, and other issues related to protocol and ethics. Further discussions explain the types of litigation conducted in United States courts, including civil actions, bankruptcy cases, criminal actions, appeals, and proceedings in special courts. Explanations of court management focus on office administration, local rules of court, case management in different types of courts, relations with other personnel, and the functions of related agencies. Guidelines are also given for conducting research and writing specific types of court documents. Appendixes presenting the Code of Conduct for Law Clerks and statutes noted in the adoption of the Code of Judicial Conduct.
