NARRATIVE REVIEW OF CASES INVOLVING SEARCH AND SEIZURE DIRECTED TOWARD DEVELOPING PRACTICAL GUIDELINES FOR POLICE OFFICERS.
Abstract
THE AUTHOR'S APPROACH IS TO STATE THE FACTS AND LAW OF SIGNIFICANT U.S. SUPREME COURT DECISIONS IN THE AREAS OF ARREST, SEARCH, AND SEIZURE. EACH DECISION IS ANALYZED AND INTERPRETED IN TERMS OF HOW IT AFFECTS LAW ENFORCEMENT ACTIONS. AN ATTEMPT IS MADE TO MAKE THE LAW ANNOUNCED IN THE DECISIONS LESS GENERAL AND MORE CLEAR. BASED UPON THE ANALYSIS OF THE DECISIONS, GUIDELINES FOR POLICE ACTION ARE SUGGESTED. TO MAKE THE GUIDELINES MOST UNDERSTANDABLE, THE REASON UPON WHICH SAID GUIDELINES ARE BASED IS STATED. AS INDICATED, THESE GUIDELINES ARE SUGGESTED FOR THE PURPOSE OF ASSISTING POLICE ADMINISTRATORS IN DETERMINING POLICY FOR POLICE PRACTICES AND PROCEDURES THAT WILL CONFORM TO THE COURT'S COMMENTARIES AND SUPPLEMENTARY COURT DECISIONS ARE STATED IN NOTES AT THE END OF EACH CHAPTER.
