COURSE REVIEW OF THE JUVENILE COURT SYSTEM - ITS JURISDICTIONAL LIMITATIONS, JUDICIAL PROCESSES AND FACT-FINDING DEVICES, AND POWER OF DISPOSITION.
Abstract
THE BOOK COVERS THE PERSONS, BEHAVIOR, AND RELATIONSHIPS CONCERNING WHICH THE AUTHORITY OF THE COURT MAY BE EXERCISED, THE ROLE OF LAW ENFORCEMENT AGENCIES AND THE INTERACTION BETWEEN POLICE AND THE JUVENILE. AT EACH STEP ALONG THE JUVENILE JUSTICE PROCESS THE NATURE OF THE CHILD'S CONSTITUTIONAL RIGHTS IS IN DOUBT, ALTHOUGH RECENTLY THE LAW TENDS TO GUARANTEE ALL PROCEDURAL SAFEGUARDS TO JUVENILES. ONE OF THE MOST FUNDAMENTAL CHANGES IN JUVENILE COURT PROCEDURES OF THE PRESENT ERA IS THE INSISTENCE OF THE SEPARATION OF THE DISPOSITION TO BE MADE OF A GIVEN CHILD FROM THE QUESTION OF WHETHER FACTS EXIST WHICH BRING HIM WITHIN THE JURISDICTION OF THE COURT. RULES OF EVIDENCE, STATUTORY LIMITATIONS, AND DISPOSITION CHOICES ARE DISCUSSED IN THE CHAPTER ON DISPOSITIONS. WAYS IN WHICH CERTAIN CHILDREN CAN BE EXCLUDED FROM JUVENILE COURT AND CONSIGNED TO CRIMINAL COURT ARE ALSO CONSIDERED.
