DESIGNED TO PROVIDE A BASIC OPERATIONAL KNOWLEDGE OF THE IMPACT OF CONSITUTIONAL LAW ON POLICE PRACTICES, THIS MANUAL INCLUDES SECTIONS ON ARRESTS, SEARCH AND SEIZURE, INTERROGATION, SUSPECT IDENTIFICATION AND SURVEILLANCE.
Abstract
THOUGH CASE CITIATIONS HAVE BEEN OMITTED FROM THE MANUAL, THE STATEMENTS AND RULES DISCUSSED ARE DERIVED FROM THE MOST RECENT UNITED STATES SUPREME COURT DECISIONS. THE MANUAL FOLLOWS A SITUATIONAL FORMAT. IT IS INTENDED TO BE USED AT THE OPERATIONAL LEVEL AND IS TABBED TO PROVIDE READY ACCESS TO THE NEEDED MATERIAL. CONFRONTATION OF THE SUSPECT, STOP AND FRISK, AND IN-FIELD OR ON-THE-SCENE IDENTIFICATIONS ARE FIRST DISCUSSED. ARREST WARRANTS, PROBABLE CAUSE ISSUES, MISDEMEANOR ARRESTS, AND THE USE OF FORCE TO MAKE AN ARREST ARE ALSO DESCRIBED. SEARCH INCIDENT TO ARREST, WHEN TO GIVE MIRANDA WARNINGS, SEARCH WITHOUT A WARRANT, SEARCHES WITH A WARRANT, AND SEARCHES OF OPEN, PUBLIC, ABANDONED OR 'PLAIN VIEW' AREAS ARE CONSIDERED AS WELL.
