Based on court cases and legislative analyses, this book discusses laws pertinent to sentencing, the law of corrections and prisoners' rights, and prisoners' rights litigation.
Abstract
The section on the law of sentencing examines guilty pleas and plea bargaining, the sentencing process, nonincarcerative sanctions, sentencing statutes and guidelines, the death penalty, and cruel and unusual punishment and noncapital cases. The section on the law of corrections and prisoners' rights addresses first amendment rights, the right of access to the courts, and prison disciplinary proceedings. Other issues considered in this section are classification, transfer, and withholding of privileges; searches, seizures, and privacy rights; due process claims for personal injuries and property deprivations; cruel and unusual punishment; parole release and probation and parole revocation; and rights upon release. The concluding section on prisoners' rights litigation covers the mechanics of litigating inmates' section 1983 suits as well as remedies. Table of cases and subject index
