Abstract
THE TEXT ITSELF IS DESIGNED FOR USE BY UNDERGRADUATE STUDENTS OF CRIMINAL JUSTICE AND FOR LAW STUDENTS. THE INSTRUCTOR'S MANUAL PROVIDES A COURSE OUTLINE AND EXAMINATION QUESTIONS FOR USE THROUGHOUT THE COURSE. KEY TEACHING POINTS FOR EACH CHAPTER ARE PRESENTED. CHAPTER TOPICS INCLUDE THE EVOLUTION OF EVIDENCE, ADMISSION OF EVIDENCE, KINDS OF EVIDENCE, PRIVILEGES, SELF-INCRIMINATION, OPINION RULE, HEARSAY, CONFESSIONS AND ADMISSIONS, EXCLUSION OF ILLEGALLY OBTAINED EVIDENCE, PREPARING AND MAINTAINING EVIDENCE, AND THE TRIAL PROCESS. MULTIPLE-CHOICE, TRUE-OR-FALSE, AND MATCHING-QUESTIONS-AND-ANSWER KEYS ARE PROVIDED. PRIMARY GOALS OF THE COURSE ARE TO PROVIDE THE STUDENT WITH A WORKING KNOWLEDGE OF THE RULES OF EVIDENCE, TO DEVELOP THE STUDENT'S ABILITY TO EVALUATE THE VARIOUS KINDS OF EVIDENCE AVAILABLE IN A GIVEN CASE, AND TO IMPRESS UPON THE STUDENT THAT LEGALLY ADMISSIBLE EVIDENCE IS THE END PRODUCT OF ALL THE EFFORTS OF THE CRIMINAL INVESTIGATOR. EVIDENCE CONSISTS OF ITEMS OF FACT WHICH PERSUADE THE MIND THAT A GIVEN PROPOSITION IS TRUE OR FALSE. THERE ARE FOUR BASIC KINDS OF EVIDENCE: ORAL TESTIMONIES, PHYSICAL OBJECTS, DOCUMENTS, AND JUDICIAL NOTICE. THE PROCESS OF PROVING THE CASE IS ACCOMPLISHED BY FOLLOWING THE VARIOUS LAWS AND RULES OF EVIDENCE WHICH ARE ESTABLISHED BY JUDGES AND LEGISLATURES. RULES OF EVIDENCE ARE STRICTLY APPLIED TO MINIMIZE LEGAL ERRORS AND GUIDE CRIMINAL JUSTICE PERSONNEL. (LWM)
