THE INDIVIDUAL, SOCIAL, AND HISTORICAL FOUNDATIONS OF THE ENTIRE LEGAL ENTERPRISE ARE EXAMINED; LEGAL ORDER IS DEALT WITH IN TERMS OF THE FOUR ARISTOTELIAN CAUSES: EFFICIENT, MATERIAL, FORMAL, AND FINAL.
Abstract
SPECIAL ATTENTION IS GIVEN TO THE MOST CONTROVERSIAL AREAS OF LAW -- DESEGREGATION, CORPORATE RESPONSIBILITY, ABORTION, AND DIVORCE LAWS -- WHILE THE OLDEST PRINCIPLES UPON WHICH AMERICAN LAW IS BASED ARE NOT NEGLECTED. LAW ENFORCEMENT, PENOLOGY, AND SOCIAL JUSTICE PROGRAMS ARE INCLUDED IN THE DISCUSSION. CONFLICTS BETWEEN MORALITY AND LAW RECEIVE CLOSE ATTENTION, AS DO JUST AND UNJUST LAWS, LAWS 'MADE TO BE BROKEN,' AND OTHER SENSITIVE AREAS. THE BASIS OF THE AUTHOR'S LEGAL PHILOSOPHY IS THAT LAW IS NOT AN ARBITRARY IMPOSITION OF RESTRAINT BUT RATHER A RESPONSE TO THE NEEDS OF INDIVIDUALS AND SOCIETY. NOTES AND REFERENCES ARE APPENDED.
