THIS REPORT REVIEWS THE BASIC CONCEPTS INVOLVED IN VICTIM COMPENSATION, THE EXISTING LEGISLATION AND LAW ON THE MATTER, AND THE LEGAL RAMIFICATIONS OF VICTIM COMPENSATION PROGRAMS.
Abstract
THE LEGAL ISSUES CONSIDERED ARE THE DEFINITION OF 'VICTIM', METHOD OF PAYMENT, TIME OF FILING CLAIMS, ELIGIBILITY, VICTIM PARTICIPATION IN ILLEGAL ACTIVITIES, AMOUNT OF COMPENSATION, APPELLATE PROCEDURES, APPLICATION PROCEDURES, AND OTHER SOURCES OF COMPENSATION. ALSO DISCUSSED ARE THE ADMINISTRATIVE AND FINANCIAL CONSIDERATIONS IN PROGRAM IMPLEMENTATION AND OPERATION, AND THE ACTIVITIES OF ATTORNEYS GENERAL UNDER EXISTING LEGISLATION. APPENDED ARE COPIES OF THE UNIFORM CRIME VICTIMS REPARATIONS ACT AND THE UNIFORM CRIME VICTIMS REPARATIONS ACT RULES OF PRACTICE AND PROCEDURE.
