PROCEDURE MANAUAL FOR LAWYERS ON THE MECHANICS OF FEDERAL CIVIL DAMAGE ACTIONS, PARTICULARLY THOSE INVOLVING POLICE MISCONDUCT.
Abstract
THIS PRACTICE MANUAL CONTAINS A DETAILED MEMORANDUM ON THE RELEVANT QUESTIONS OF LAW, A SET OF SAMPLE PLEADINGS, AND A SELECTION OF POLICE DEPARTMENT FORMS TO AID IN DISCOVERY. THE MATERIALS FOCUS ON THE LAW IN THE NORTHERN DISTRICT OF ILLINOIS, HOWEVER, THE EDITORS INDICATE THAT THE BULK OF THE INFORMATION PROVIDED SHOULD BE HELPFUL IN FILING CIVIL DAMAGE ACTIONS INVOLVING POLICE MISCONDUCT IN OTHER JURISDICTIONS AS WELL. THE MEMORANDUM OF LAW CONCENTRATES ON CASES WHICH ARE CONTROLLING IN THE SEVENTH CIRCUIT BUT HAS EXTENSIVE CITATIONS TO CASES IN OTHER JURISDICTIONS. THE SAMPLE PLEADINGS SET FORTH A STRUCTURE OF ALLEGATION AND ARGUMENT WHICH FOCUSES ON DEFENSES WHICH ARE LIKELY TO BE RAISED BY THE CHICAGO POLICE DEPARTMENT. (AUTHOR ABSTRACT MODIFIED)
