This guide to legal resources relevant to the Federal Bureau of Prisons (BOP) includes statutes, regulations, program statements, and current case law pertinent to issues that the BOP is currently facing; a general overview of the BOP, its services, and programs is also provided.
Abstract
The material presented is divided into three sections: pretrial issues, sentencing issues, and postconviction issues. The introduction describes the BOP's mission and population. Pretrial issues encompass pretrial detention, special medical concerns, interstate agreement on detainers, and the management of defendants and offenders with mental illness. The various sentencing issues are grouped under intermediate punishments, imprisonment, and judgment and commitment orders. Intermediate punishments encompass community confinement, intermittent confinement, home detention, and Intensive Confinement Centers (ICC's). ICC's are minimum-security facilities that offer specialized programs composed of "boot camp" institution-based and community-based phases. The section on imprisonment addresses institutional confinement, the service of sentence in non-Federal facilities, and juveniles. Issues pertinent to judgment and commitment orders are as follows: judicial recommendations for a specific institution, geographic area, or specialized program; sentence calculation; commencement of a term of imprisonment; credit for prior custody; credit for satisfactory behavior; fines and costs of confinements; inmate financial-responsibility program; and victim and witness notification. Legal parameters pertinent to postconviction issues pertain to the designation to a facility for a term of imprisonment; inmate admission and orientation program; programs and general services; visiting, telephones, and correspondence; inmate discipline process; access to the courts; administrative remedy program; personal property; special administrative measures; family emergencies and temporary releases; and release.
