ANALYSIS OF THE PROCESS OF CONVICTION, SENTENCING, POSTCONVICTION PROCEDURES AND REMEDIES, AND THE RIGHTS RETAINED BY PRISONERS UPON INCARCERATION.
Abstract
THE CORRECTIONAL PROCESS HAS BEEN LARGELY IGNORED BY THE LAW SCHOOLS, THE LEGAL PROFESSION, AND SOCIETY IN GENERAL. ONLY IN RECENT YEARS HAVE CRITICS STARTED LOOKING AT THE FIELD OF PRISONERS' RIGHTS AND THE ACTIONS OF THOSE RESPONSIBLE FOR MAINTAINING INSTITUTIONS AND DEVELOPING PROGRAMS TO REHABILITATE OFFENDERS. IN ADDITION, EDUCATIONAL INSTITUTIONS ARE RESPONDING TO THIS AWARENESS BY PROVIDING COURSES IN CRIMINAL CORRECTIONS FOR STUDENTS OF LAW AND THE ADMINISTRATION OF JUSTICE. LEGAL RIGHTS OF THE CONVICTED WILL PROVE USEFUL TO LEGISLATORS, LAWYERS, SOCIAL WORKERS, EDUCATORS, AND CITIZENS WHO ARE CONCERNED WITH THE PROBLEMS OF THE CONVICTED. IT ADDRESSES CONVICTION OR ADJUDICATION OF DELINQUENCY AND THE SENTENCING PROCESS. THE APPELLATE PROCESS, WHEREBY THE VALIDITY OF A CONVICTION IS DIRECTLY CHALLENGED, AND POST-CONVICTION COLLATERAL ATTACKS ARE PRESENTED IN DETAIL. THE STUDY FOCUSES ON LEGAL RIGHTS OF PRISONERS, PROBATIONERS, AND PAROLEES, AS WELL AS STATE AND FEDERAL REMEDIES FOR ENFORCEMENT OF THESE RIGHTS. ANALYZED ARE THE FREEDOM OF RELIGION, ACCESS TO THE COURTS, FREEDOM OF COMMUNICATION, AND THE RIGHTS TO ADEQUATE CARE, SAFETY, AND MEDICAL ATTENTION. DETAILED APPENDIXES INCLUDE EXCERPTS FROM THE UNITED STATES CONSTITUTION AND FEDERAL STATUTES WHICH PERTAIN TO PRISONER CARE, TREATMENT, OR RIGHTS, AND NUMEROUS MODEL STATUTES AND STANDARDS.
