FEDERAL LAWS RELEVANT TO COMPUTER ABUSE ARE EXAMINED IN THIS REVIEW.
Abstract
AT LEAST 40 SECTIONS OF TITLE 18 OF THE UNITED STATES CODE BEAR DIRECTLY OR INDIRECTLY ON COMPUTER ABUSE. THESE ARE GROUPED AND ANALYZED WITHIN SEVEN BROAD CATEGORIES: THEFT AND RELATED OFFENSES; ABUSE OF FEDERAL CHANNELS OF COMMUNICATION; NATIONAL SECURITY OFFENSES; TRESPASS AND BURGLARY; DECEPTIVE PRACTICES; MALICIOUS MISCHIEF AND RELATED OFFENSES; AND MISCELLANEOUS. THE PAPER ALSO TOUCHES ON LEGAL PROBLEMS ASSOCIATED WITH THE SECURITY OF ELECTRONIC FUNDS TRANSFER SYSTEMS. THE PROBLEMS HAVE BEEN CONSIDERED IN A MARYLAND LAW REVIEW ARTICLE (EXTENSIVELY QUOTED IN THE PRESENT ARTICLE), WHICH NOTED THE FOLLOWING AREAS IN WHICH PROTECTIVE CRIMINAL LAW SANCTIONS ARE RELEVANT TO ELECTRONIC FUNDS TRANSFER SYSTEM SECURITY: UNAUTHORIZED ACCESS TO A CUSTOMER'S ACCOUNT BY MEANS OF STEALING OR REPRODUCING AN ACCESS DEVICE (E.G., THE PLASTIC CARD); UNAUTHORIZED ACCESS TO ACCOUNTS BY PERSONNEL MANNING ACCESS TERMINALS; UNAUTHORIZED ACCESS TO COMMUICATION LINES BETWEEN REMOTE TERMINALS AND INFORMATION STORAGE AREAS; AND UNAUTHORIZED ACCESS AT THE CENTRAL PROCESSING SITE.
