THIS ARTICLE EXAMINES AN OHIO STATUTE WHICH PROVIDES FOR PUBLICATION OF OPINIONS OF THE VARIOUS STATE COURTS OF APPEAL, RECOGNIZING ONLY THOSE SELECTED BY A MAJORITY OF JUDGES AND PUBLISHED IN ONE OF TWO SOURCES.
Abstract
THE SCOPE OF THE STATUTE, THE UNPUBLISHED OPINION DILEMMA IN OTHER JURISDICTIONS, AND A SUGGESTED RESOLUTION OF THE PROBLEM ARE PRESENTED. THE AUTHOR CONCLUDES THAT THE USE OF UNREPORTED CASES AS SECONDARY AUTHORITIES IS NOT IMPROPER, BUT THEIR USE AS PRIMARY AUTHORITIES IS INAPPROPRIATE....EB
