This report considers the major provisions of the statutes relating to criminal prosecutions for sexual assault in Wisconsin as reviewed by the Legislative Council's Special Committee to Review Sexual Assault Laws and addresses several related issues: admissibility of evidence, the elements of offenses and definitions applicable to those offenses, penalties, and the interrelationship of criminal prosecutions and the filing of civil suits by alleged offenders against alleged victims of sexual assault.
Abstract
Key provisions of Wisconsin's sexual assault legislation pertain to the closure of preliminary examinations in criminal cases involving sexual assault, sexual exploitation, or incest; criminal liability based on omissions or criminal recklessness and the provision of penalties; sexual assault, intercourse, and contact; limitations on discovery in a civil action based on sexual assault or sexual exploitation.
