FINDINGS OF A NATIONAL SURVEY DESIGNED TO COLLECT, DIGEST AND ANALYZE STATE AND FEDERAL LAWS AND PROPOSED LEGISLATION DEALING WITH FENCING ACTIVITIES.
Abstract
AN ANALYSIS OF PRESENT LAWS AND AN EXAMINATION OF STATUTORY AND CASE LAW DEFINITIONS RELATED TO DEALING IN STOLEN GOODS ARE FOLLOWED BY A GENERAL DISCUSSION OF BOTH FEDERAL AND STATE LEGISLATION, CHALLENGES TO THESE LAWS, AND PROPOSALS FOR CHANGING THE CRIMINAL RECEIVING LAWS. THE REMAINDER OF THIS REPORT, WITH ITS ACCOMPANYING STATE-BY-STATE TABLES, IS DEDICATED TO AN EXAMINATION OF THE ANTI-FENCING STATUTES AS THEY PERTAIN TO CIVIL AND CRIMINAL PENALTIES, THE ILLICIT TRADE IN MOTOR VEHICLES, AND THE CONDUCT OF PAWNBROKERS AND JUNK OR SECOND HAND DEALERS. A MODEL THEFT AND FENCING ACT, WITH SECTION-BYSECTION COMMENTARY, IS APPENDED.
