This article provides information on principles and legal issues that underpin appropriate management of gay, lesbian, bisexual,transgender, or intersex (LGBTI) inmates.
Abstract
This article presents information and guidance on managing inmates who openly identify as homosexual or who do not fit society's "easy" definitions of male or female. Issues discussed include how to appropriately search an inmate of ambiguous gender, where to safely house the detainee, and what clothing should be provided or available for purchase. Also addressed is the question of whether an agency is responsible for providing sex-change medications and/or surgery for inmates seeking to change their physical sex. Definitions of terms such as "gender identity," "transgender," "trans-woman," "gender dysphoria," and "intersex" are also provided. A framework for translating these concepts into effective and defensible correctional policy and practice is also discussed.
