For the past century, courts have been involved in the licensing and regulation of the private security industry.
Abstract
The courts have long recognized the power of government to regulate businesses and professions whose activities concern the general public welfare. Government authorities have used their police powers to regulate private detectives, private investigators, and security services. The courts' interpretation and evaluation of the statutory requirements for licensing are examined through a review of specific cases. These statutory requirements relate to the character of the individual seeking a license to operate in the private security industry, the experience required, bonding potential, and prohibited employment. 39 references
