AN EXAMINATION OF THE POSSIBLE IMPACT OF ADMISSION OF POLYGRAPH EVIDENCE ON THE CONCEPTS, EFFECTUATION, AND PRACTICE OF THE LAW.
Abstract
THE INABILITY OF THE POLYGRAPH TO PERFORM THE HUMAN FUNCTION OF EVALUATION OF IMPONDERABLES IS SEEN AS ITS MAJOR DEFICIENCY. EFFECTS ON JURORS. ACCUSTOMED TO RESPECTING MODERN TECHNOLOGY, MAY ALSO BE DETRIMENTAL TO THE INTERESTS OF JUSTICE. THE AUTHOR WARNS THAT USE OF POLYGRAPH EVIDENCE MAY RESULT IN A TENDENCY TOWARD 'APPLIED MANIPULATIVE LAW' IN WHICH BASIC FACTS, AS PRESENTED BY THE POLYGRAPH, ARE INSERTED INTO A FORMULA, AND A PRE-ORDAINED DECISION IS REACHED.
