A CRITIQUE OF LITERATURE ON COURT ADMINISTRATION IS PRESENTED AS A RESEARCH TOOL FOR STUDENTS AND PRACTITIONERS.
Abstract
MOST OF THE LITERATUE ANALYZED DEALS WITH THE MANAGEMENT OF THE COURT SYSTEM, I.E., COURTS AND AUXILIARY ADMINISTRATIVE AGENCIES, INCLUDING PERSONNEL, PROCEDURES, AND STRUCTURES. LIMITED ATTENTION IS DIRECTED TO SUCH TOPICS AS POLICE BEHAVIOR, THE LEGAL PROFESSION, AND CORRECTIONS, AND TO THE MORE ESOTERIC SOCIAL SCIENCE LITERATURE ON JUDICIAL DECISIONMAKING. AN OVERVIEW OF SOURCES IDENTIFIES CASEBOOKS, TEXTS, PERIODICALS, AND BIBLIOGRAPHIES. SUBSEQUENT SECTIONS DESCRIBE LITERATURE ON THE HISTORY OF JUDICIAL ADMINISTRATION; JUDICIAL PERSONNEL, INCLUDING JUDGES (RECRUITMENT AND SELECTION, POST-SELECTION SOCIALIZATION, FINANCIAL AND ETHICAL ELEMENTS OF THE OFFICE), PARAJUDGES, AND OTHER PERSONNEL; ORGANAZATION OF THE COURTS; BUSINESS OF THE COURTS, INCLUDING CASE FLOW MANAGEMENT IN TRIAL COURTS (OVERVIEWS, MANAGERIAL AND TECHNOLOGICAL FUNCTIONS, PROCESSING STAGES) AND IN APPELLATE COURTS, AND MANAGEMENT OF THE COURT SYSTEM (AUXILIARY ADMINSTRATIVE FUNCTIONS, JUDICIAL GOVERNANCE, JUDICIAL DISCIPLINE AND REMOVAL, FINANCIAL GOVERNANCE, RULEMAKING, COURT FACILITIES, PRESS RELATIONS); AND STRATEGIES OF CHANGE.
