Abstract
THE TEXT COVERS THE HISTORY OF ENGLISH COURTS AND THE COMMON LAW TRADITION; THE STRUCTURE, ORGANIZATION, AND PROCEDURES OF COURTS WITH CIVIL JURISDICTION, COURTS WITH CRIMINAL JURISDICTION, AND TRIBUNALS; HABEAS CORPUS AND CONTEMPT OF COURT; THE ROLES OF COURT PERSONNEL; COURT COSTS; AND THE OUTLOOK FOR REFORM. THE SEVENTH EDITION REFLECTS CHANGES BROUGHT ON BY THE INDUSTRIAL RELATIONS ACT 1971, WHICH INTRODUCED A NEW PATTERN OF LABOR LAW AND SET UP A NATIONAL INDUSTRIAL RELATIONS COURT, AND THE COURTS ACT 1971, WHICH ESTABLISHED A NEW SYSTEM FOR CIVIL AND CRIMINAL COURTS. THE FORMER HAS PROFOUNDLY ALTERED THE BALANCE BETWEEN LAW COURTS AND TRIBUNALS, WHICH NOW DEAL WITH ISSUES THAT ARISE OUT OF ORDINARY INCIDENTS OF EMPLOYMENT. THE CHAPTER ON TRIBUNALS HAS BEEN RECAST AND EXPANDED TO REFLECT THIS CHANGE IN THEIR JURISDICTION. ADMINISTRATIVE CHANGES REFLECTED IN THE TEXT RELATE TO THE HANDLING OF UNDEFENDED DIVORCE CASES AND SMALL CLAIMS BY THE CIVIL COURTS, THE INCREASING VOLUME OF CASES BROUGHT BEFORE THE CRIMINAL COURTS, GROWING CRITICISM OF CRIMINAL PROCEDURES (LAW OF EVIDENCE, JURY TRIAL), AND BAIL REFORMS, CHAPTERS ON LEGAL AID AND THE AVAILABILITY OF LEGAL SERVICES HAVE BEEN REVISED IN LIGHT OF CRITICISM OF EXISTING PROVISIONS.
