A CRITICAL APPRAISAL OF COURTS, RELATED JUDICIAL INSTITUTIONS, AND THEIR OPERATIONS ON PRINCE EDWARD ISLAND (CANADA), FOLLOWED BY SWEEPING RECOMMENDATIONS FOR INSTITUTIONAL ABOLISHMENT AND/OR REFORM.
Abstract
ONE OF THE MAJOR PROBLEMS SEEMS TO BE THAT MANY OF THE JUDICIAL INSTITUTIONS ON PRINCE EDWARD ISLAND WERE IMPORTED IN TOTALITY FROM ENGLAND, WHERE THEY MAY WELL HAVE HAD VALID REASONS FOR EXISTENCE, BUT ARE NOW OBSOLESCENT. THESE IMPORTS INCLUDE THE COURT OF CHANCERY AND THE COURT OF APPEAL IN EQUITY, GRAND JURIES, AND COURT LONG VACATIONS. COURTS ARE CLOSED IN JULY AND AUGUST EACH YEAR. OTHER RECOMMENDATIONS AND SUGGESTIONS ARE PRESENTED IN THIS EMINENTLY READABLE REPORT.
