This reference text provides an overview of policies and procedures followed by the Magistrates' Court in Great Britain.
Abstract
Materials include a discussion of options, legislation and legal precedents, commentary, and sample court orders and announcements. Preliminary procedures cover detention warrants, adjournments and remands, protection of juveniles, and legal aid. Also considered are committal proceedings, determination of guilt and innocence, offenses taken into consideration, announcement of the sentence, and deferment of sentence. The section on sentencing examines sentencing options of imprisonment, suspended or partly suspended sentences, committal to Crown Court, detention centers, youth custody, community service, hospital orders, fines, compensation, probation, deprivation of property, and restitution. A section on juvenile court considers both criminal and care (custody) proceedings. Domestic court procedures considered include interim, matrimonial case, agreed, living-apart, guardianship, affiliation, personal protection, and adoption orders, as well as enforcement of maintenance payments. The second section provides information on the purposes and procedures of the major committees on which magistrates serve. Among these are domestic court panels, statutory annual meetings, the police authority, the probation committee, and licensing committees.
