This article discusses the problems rental companies have had in selecting clientele and employees, protecting their assets, and achieving recognition from law enforcement personnel and the courts.
Abstract
It reviews the rent with the option to purchase, a new term that now appears in many rental agreements, and details some of the problems such agreements create. They include attracting a less than desirable clientele, the reputed development of the rental industry as a quasi-loanshark business, and the problems, particularly in the television and appliance rental business, of collecting on a bad account. In addition, the civil courts have no applicable law to cover a rental agreement, limiting legal action against the customer to small claims court. To improve the situation, the article recommends hiring rental agents or collectors who treat each case fairly and consistently, making sure rental contracts are understood by the customer, and keeping customers informed of their obligations. Benefits rental companies can offer both the consumer and the economy are outlined, with the qualification that rental companies must improve their methods of selecting employees and clientele and agree to appropriate controlling legislation.
