Abstract
This issue paper from the American Probation and Parole Association discusses ways to manage the risks posed by offender computer use. One way to manage these risks is through the passage of legislation at the State and local levels. Between 2007 and 2008, 23 States introduced legislation that restricts or prohibits Internet access by sex offenders. In addition, by July 2009, 25 States had established laws mandating that Internet identifiers be included in sex offender registration. Most of the statutes enacted by these States are specific to sex offenses, however, some statutes also authorize Internet restrictions for other offenses. Some States have also enacted laws that allow courts to establish conditions for restricting or prohibiting Internet or computer use for offenders under supervision. This paper discusses five components of good computer management that are necessary for the effective supervision of people on probation, parole, or supervised release. These five components are 1) accurate and up-to-date knowledge about what computers a supervisee has or may use; 2) deciding how to monitor the supervisee's computer or Internet use; 3) the need for officers to go beyond the traditional brick and mortar world to cyberspace; 4) incorporation of complementary technologies that augment computer management; and 5) the use of field visits by probation and parole officers.
