AN INTRODUCTION IS PROVIDED TO THE INTERSTATE CRIME CONTROL LEGISLATION GOVERNING THE TRANSPORT OF PRISONERS ACROSS STATE LINES.
Abstract
THE PURPOSES, STATUTORY BASES, AND MANNER OF PERFORMANCE OF PRISONER TRANSPORT ARE OUTLINED TO PROVIDE FULL UNDERSTANDING OF THE LEGAL REQUIREMENTS AND OPPORTUNITIES FOR ARRANGING COOPERATIVE INTERSTATE PRISONER TRANSPORT THROUGH THE COMPUTER ASSISTED PRISONER TRANSPORTATION INDEX SERVICE (CAPTIS), DEVELOPED TO FACILITATE THE COST-EFFECTIVE TRANSPORT OF PRISONERS ACROSS STATE LINES. BASICALLY, THE LEGISLATION GOVERNING THE TRANSPORTATION OF PRISONERS MANDATES TWO CATEGORIES OF TRANSPORT: (1) TRANSPORT OF FUGITIVES FROM JUSTICE, WITNESSES IN CRIMINAL PROCEEDINGS, DESERTING SPOUSES REFUSING TO SUPPORT THEIR FAMILIES, AND PERSONS OF UNSOUND MIND, ALL OF WHICH ARE ACCOMPLISHED PURSUANT TO UNIFORM LAWS PROMULGATED BY THE NATIONAL CONFERENCE OF COMMISSIONERS ON UNIFORM STATE LAWS, AND (2) TRANSPORTS OF PAROLE AND PROBATION VIOLATORS, INMATES OF PENAL OR CORRECTIONAL INSTITUTIONS, JUVENILES, AND THE MENTALLY ILL, WHICH ARE UNDERTAKEN IN ACCORDANCE WITH INTERSTATE COMPACTS SPONSORED BY THE COUNCIL OF STATE GOVERNMENTS. TRANSPORT UNDER THE UNIFORM LAWS AND THE INTERSTATE COMPACTS ARE DISCUSSED, AND IT IS CONCLUDED THAT THE LEGISLATIVE FOUNDATIONS AND PERFORMANCE PROCEDURES FOR INTERSTATE PRISONER TRANSPORTS ARE FULLY CONGRUENT WITH THE IMPLEMENTATION AND OPERATIONS OF THE CAPTIS PILOT SYSTEM.
