This manual for use by clerks of South Dakota's circuit courts provides guidelines and detailed information on filing, docketing, and other court precedures.
Abstract
The first section on filing and docketing contains chapters which focus on procedures for civil matters, estate matters, adoption cases, and criminal proceedings. Each chapter includes procedures for initiating actions and fee schedules are included in each chapter. The second section covers procedures for small claims; jury selection, summons, and reimbursement; and appeals. In the third section, miscellaneous duties and information are presented, including courtroom duties, the disqualification of a judge or a magistrate, change of venue, wills, the court calendar, terms of court, and monthly reports to the auditor. Also presented are procedures for subpoenas and the attendance of witnesses, the acknowledgement of instruments, records open to inspection, the consent of sale of real property by cotenant. Additional procedures cover the retention of exhibits, unorganized counties, and reports to the Department of Health. Other sections discuss microfilming and the retention of records, forms, accounting, judicial information reporting, personnel rules, administrative directives, and Supreme Court rules. A glossary is included.
