This manual for South Dakota lay magistrates provides guidelines and information on procedures involving petty offenses, criminal charges, small claims, and other matters.
Abstract
The petty offense procedures section covers the accused's options for traffic and nontrafic violations, methods for making deposits, the disposition of uncontested cases, adjudication, docketing and forwarding of judgments to the Motor Vehicles Division, and awards and costs. A procedural checklist for contested cases and a list of apparent petty offenses are also included. In the criminal procedures section, individual chapters focus on arrests, initial appearances, bail, preliminary hearings, arraignments, and search warrants. Some chapters provide definitions, sample dialogues, and procedures checklists. The small claims and miscellaneous procedures section includes chapters on small claims, solemnizing marriages, and paternity proceedings. Other chapters discuss the magistrate as coroner, oaths and acknowledgements, subpoenas and the attendance of witnesses, and the taking of dispositions. Procedural checklists and fee information are provided. Two additional sections contain copies of court forms and schedules of punishments. A glossary of court terms is included.
