THIS PLAN OUTLINES THE STATE'S POLICY POSITION WITH RESPECT TO THE SECURITY AND PRIVACY OF CRIMINAL HISTORY RECORD INFORMATION ALONG WITH STEPS AND PROCEDURES TO BE TAKEN TO COMPLY WITH REQUIREMENTS OF FEDERAL REGULATIONS.
Abstract
THE AREAS COVERED ARE COMPLETENESS AND ACCURACY OF RECORD INFORMATION, LIMITS ON DISSEMINATION, ANNUAL AUDITS AND QUALITY CONTROL, SECURITY, AND THE RIGHT OF INDIVIDUAL ACCESS AND REVIEW. THE MAJOR PLAN POLICY CALLS FOR THE CREATION AND MAINTENANCE OF A CENTRAL REPOSITORY FOR COMPLETE CRIMINAL HISTORY RECORD INFORMATION ON ALL ADULTS FORMALLY ARRESTED AND PROCESSED BY THE CRIMINAL JUSTICE SYSTEM THOROUGHOUT THE STATE. TO THE MAXIMUM EXTENT TECHNICALLY, ADMINISTRATIVELY, AND FISCALLY FEASIBLE ALL DISSEMINATIONS OF CRIMINAL HISTORY RECORD INFORMATION ANYWHERE IN THE STATE WOULD BE CHECKED AGAINST THE RECORDS MAINTAINED BY THE CENTRAL REPOSITORY TO ASSURE THAT ONLY THE MOST ACCURATE, COMPLETE, AND TIMELY INFORMATION IS DISSEMINATED. A TIME TABLE OF MAJOR MILESTONES FOR THE IMPLEMENTATION OF THE PLAN IS PROVIDED ALONG WITH AN ESTIMATE OF THE COSTS TO BE INCURRED. FOUR APPENDICES ARE PROVIDED IN THIS DOCUMENT. APPENDIX A IS A COPY OF THE STATE STATUTE WHICH WAS ADOPTED INTO MARYLAND LAW ON MAY 4, 1976. APPENDIX B INCLUDES THE CERTIFICATION REQUIREMENTS AND INTERIM AGENCY PROCEDURES FOR THE RIGHT OF INDIVIDUAL ACCESS AND REVIEW FOR THOSE AGENCIES DIRECTLY AFFECTED BY THE FEDERAL REGULATIONS. APPENDIX C IS THE INTERIM RULES PROVIDING FOR THE RIGHT OF INDIVIDUAL ACCESS AND REVIEW OF CRIMINAL HISTORY RECORD INFORMATION MAINTAINED BY THE CENTRAL REPOSITORY.
