MOTOR VEHICLE REGULATIONS, DRUG LAWS, GUN LAWS, AND SHOPLIFTING ARE REVIEWED AS FOUR SUBSTANTIVE AREAS OF THE CRIMINAL LAW IN MASSACHUSETTS THAT ARE REFERRED TO AS COMMON CRIMES.
Abstract
THESE CRIMES, AND POLICE PROCEDURES TO ACCOMPANY INVESTIGATION AND ENFORCEMENT, ARE EXPLAINED IN EASY-TO-UNDERSTAND LANGUAGE IN A LOGICAL MANNER. THE SECTION ON MOTOR VEHICLE REGULATIONS CONSIDERS POLICE PROCEDURES (MOTOR VEHICLE CITATIONS, WARRANTLESS ARRESTS, AND REFUSAL TO SUBMIT TO AN OFFICER); COMMON CRIMES SUCH AS SPEEDING, OPERATING UNDER THE INFLUENCE OF ALCOHOL, OPERATING A VEHICLE WITHOUT A LICENSE, LEAVING THE SCENE OF AN ACCIDENT, AND UNINSURED MOTOR VEHICLES; RULES OF MOTOR VEHICLE OPERATION; SPECIAL-PURPOSE CRIMES, E.G., ABANDONED MOTOR VEHICLES, MOTOR VEHICLES USED IN THE COMMISSION OF A FELONY, LARCENY OF A MOTOR VEHICLE, ACCIDENT REPORTS, AND LITTERING; EQUIPMENT; PARKING VIOLATIONS AND TOWING; SPECIAL-PURPOSE VEHICLES (MOTORCYCLES, SCHOOL BUSES, LEASED VEHICLES, AND DRIVING SCHOOLS); AND THE HABITUAL TRAFFIC OFFENDER. THE SECTION ON CONTROLLED SUBSTANCES DEALS WITH THE CONTROLLED SUBSTANCES ACT MADE EFFECTIVE IN MASSACHUSETTS IN 1972, THE RIGHT OF ARREST, PHOTOGRAPHING AND FINGERPRINTING, PROTECTIVE CUSTODY, ADMINISTRATIVE INSPECTION WARRANTS, INSPECTIONS AND SEIZURES WITHOUT A WARRANT, AND FORFEITURE (PROPERTY, CONVEYANCES, AND PLANTS). THE SECTION ON GUN LAWS DEFINES TERMS (FIREARM, AMMUNITION, COMMISSIONER, LICENSING AUTHORITY, GUN, AND EXEMPT PERSON) AND EXAMINES FIREARM IDENTIFICATION CARDS, LICENSE TO CARRY, PERMIT TO PURCHASE, TEMPORARY LICENSE TO CARRY, DEALERS, AMMUNITION, ALIENS, MACHINE GUNS, SPECIFIC CRIMES ASSOCIATED WITH FIREARMS AND GUNS, AND FORFEITURE AND CONFISCATION.
