Abstract
THE RATE OF APPEAL (RA) CAN BE DETERMINED BY DIVIDING THE NUMBER OF APPEALS FILED BY THE NUMBER OF APPEALABLE DECISIONS. DATA CONCERNING THE NUMBER OF APPEALS IS READILY AVAILABLE. HOWEVER, FOR THE SAKE OF CONSISTENCY, IT MUST BE DETERMINED WHETHER THE NUMBER OF APPEALABLE DECISIONS INCLUDE CONTESTED JUDGMENTS PLUS DEFAULTS AND DISMISSALS FOR WANT OF PROSECUTION OR JUST CONTESTED JUDGMENTS. EITHER WAY, CONSISTENCY WILL PERMIT VALID COMPARISON BETWEEN YEARLY RATES.
