THIS REPORT DISCUSSES THE ROLE OF MENTAL DISORDER AT VARIOUS STAGES OF THE CANADIAN CRIMINAL JUSTICE SYSTEM, AND HOW THE SYSTEM MIGHT BETTER HANDLE SUCH OFFENDERS.
Abstract
PRELIMINARY CONCERNS - SUCH AS LEGISLATIVE LANGUAGE, PUBLIC ATTITUDES, AND GENERAL POLICY TOWARDS THE MENTALLY DISTURBED - ARE DISCUSSED. THE ROLE OF MENTAL DISORDER IS THEN ANALYZED AS IT RELATES TO PRETRIAL ISSUES, THE ISSUES OF FITNESS, THE ISSUE OF RESPONSIBILITY, AND THE ISSUES OF DISPOSITION. THE USE OF MENTAL HEALTH RESOURCES IN THE CRIMINAL PROCESS IS DISCUSSED. FINALLY, RECOMMENDATIONS FOR POLICY AND IMPLEMENTATION ARE MADE FOR EACH OF THESE AREAS. --IN ENGLISH AND FRENCH
